Governing Law and Arbitration
Any legal issues arising from or related to your visit to the Site or services provided through our Site shall be construed in accordance with, and all questions with respect thereto shall be determined by, the laws of the State of Massachusetts applicable to contracts entered into and wholly to be performed within that state. Any party seeking temporary or preliminary injunctive relief may do so in any state or federal court in Massachusetts having jurisdiction thereof. Except as set forth above, the state and federal courts of Tennessee shall be the exclusive forum and venue to resolve disputes arising out of or relating to these Terms or any use of merchandise sold through our Site. By using our Site, and thereby agreeing to these Terms, users consent to personal jurisdiction and venue in the state and federal courts in Massachusetts with respect to all such disputes.
Miscellaneous
Our failure to insist upon or enforce strict performance of any provision of these Terms shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of these Terms. We may change, suspend or discontinue any aspect of our Site or service at any time. EH reserves the right to change system configurations, product specifications, upgrades, pricing, layouts, options and any other specifications at any time without notice. We may also impose limits or restrictions on certain services, features or content or restrict your access to parts or all of our Sites without notice or liability.
Entire Agreement
These Terms of Use, together with the Payment Terms and Privacy Policy, constitute the entire agreement between you and ElectronicHouse.com regarding your use of the Services. In the event of a conflict between the Payment Terms and the Terms of Use, the Payment Terms will govern.
